Egress Window Requirements in Portland: Code, Size, and What Passes Inspection
The basement has been a bedroom for years — maybe decades. A bed sits against one wall, a dresser against another, and a small horizontal slider window near the ceiling lets in a rectangle of daylight that barely reaches the floor. The room functions as a bedroom. The problem is that it doesn't meet the legal definition of one. That window is too small to climb through in a fire, too high off the floor to reach quickly, and there's no window well outside to escape into. The room is a bedroom in practice and a storage room on paper. The difference between the two is an egress window.
Egress window requirements exist for one reason: a person sleeping in a below-grade or upper-floor bedroom needs a second way out if fire blocks the interior path. The building code specifies exact dimensions — not guidelines, not recommendations — that every egress opening must meet to pass inspection. Portland enforces these requirements through the 2021 Oregon Residential Specialty Code (ORSC), Section R310 — Emergency Escape and Rescue Openings. The city requires a building permit for every egress window installation.

Net clear opening is the critical measurement — and the one that causes the most confusion. The net clear opening is the actual space available to pass through when the window is fully open. A window with a large frame doesn't meet the requirement if the operable sash only opens to 5.0 square feet. The window's rough opening size and the frame size don't matter. What matters is the clear space a person can physically fit through when the window is open as far as it goes.
The 5.7 vs. 5.0 distinction. Oregon code requires 5.7 square feet of net clear opening for bedrooms above grade level. Below-grade bedrooms — basements — are allowed 5.0 square feet if the window opens directly to a window well. The reduced requirement at grade level accounts for the fact that a person exiting through a window well is already at or near ground level and doesn't face a drop on the other side.
Maximum sill height. The bottom of the egress opening cannot be higher than 44 inches above the finished floor. In basement bedrooms, this is often the dimension that fails — existing windows sit near the ceiling, with sill heights of 60-72 inches. That window is unreachable for children and difficult for adults in an emergency. The new egress window cuts lower into the foundation wall to bring the sill within the 44-inch maximum.

Wall Types and Installation Complexity

Poured concrete is the most common foundation wall type in Portland homes built after 1950. Cutting an egress opening in poured concrete requires a concrete saw — a wet-cut diamond blade that cuts through the wall cleanly without fracturing the surrounding concrete. The structural header above the new opening distributes the load around the cut. Rebar in the wall needs to be located before cutting to avoid cutting through structural reinforcement in the wrong location.
CMU (concrete masonry unit) foundations are found in Portland homes built from the 1940s through the 1970s. Window Well Requirements
Below-grade egress windows require a window well — an excavated area outside the window that provides space to climb out and up to ground level. The window well has its own set of code requirements that are separate from the window itself.
Minimum 9 square feet of floor area. The well must provide enough space for a person to stand, turn, and begin climbing out. A 36-inch by 36-inch well meets the minimum — but larger wells are easier to use and provide more light to the bedroom inside.
Minimum 36-inch width and 36-inch projection from the wall. The well must be wide enough and deep enough from the wall to allow a person to fully exit the window and stand in the well.
Ladder or steps required when the well depth exceeds 44 inches. Most Portland basement egress wells are deeper than 44 inches because the basement floor is typically 6-8 feet below grade. A permanent ladder, built-in steps, or a step system integrated into the well wall provides the means to climb from the well floor to grade level. The ladder must be usable — rungs spaced for climbing, not decorative.
Drainage. Oregon code doesn't specify the exact drainage method, but the practical requirement in Portland is clear: a window well that collects water is a window well that floods the basement. Portland's 36+ inches of annual rainfall — most of it arriving between October and May — means every below-grade window well needs a drainage solution. A gravel base with a drain line connected to the perimeter drainage system is the standard approach. In areas with high water tables or poorly draining clay soil, a dedicated sump or drain connected to the storm system may be necessary.
Window well covers. Not required by code, but strongly recommended in Portland. A clear polycarbonate cover keeps rain, leaves, and debris out of the well while allowing light into the bedroom and maintaining the emergency exit function. The cover must be operable from inside the well — a cover that requires tools or keys to open defeats the egress purpose.
What the Inspector Checks
Every egress window installation in Portland requires a building permit and at least one inspection. Knowing what the inspector measures avoids failed inspections and re-work.
Net clear opening. The inspector opens the window fully and measures the clear space. Height times width must equal or exceed 5.7 square feet (or 5.0 for below-grade). Both the height and width must meet the minimums of 24 inches and 20 inches, respectively. A window that's 30 inches wide and 28 inches tall provides 5.8 square feet — it passes on area but not on individual dimensions. A window that's 18 inches wide and 40 inches tall provides 5.0 square feet — it fails the minimum width requirement, even though the area calculation might work with different math.
Sill height. Measured from the finished floor to the bottom of the clear opening. Must be 44 inches or less. If the basement floor is unfinished concrete that will later be covered with flooring, the measurement should account for the finished floor height.
Window operation. The window must open fully without tools, keys, or special knowledge. A casement window with a crank that opens to the full clear area passes. A double-hung where only the bottom sash opens — and the bottom sash alone doesn't provide enough clear area — fails. Sliding windows where only half the window opens need to be sized so that the operable half alone meets the full requirement.
Window well dimensions. Area, width, projection from wall, and depth measured. Ladder or steps inspected if the well exceeds 44 inches in depth. The ladder must be permanently attached — a removable ladder that someone has to retrieve during a fire doesn't meet the requirement.
Structural work. The header above the new opening, the support of the foundation wall, and the connection to the existing structure. The inspector verifies that the structural modifications match the approved plans.
Code Exceptions and Special Situations
The Oregon Residential Specialty Code includes several exceptions and special conditions that apply to specific egress scenarios.
Replacement windows. ORSC Section R310.2.6 provides an exception for replacement windows in existing openings. If the existing window opening is too small for a full egress-compliant window, the replacement window must be the manufacturer's largest standard size that fits the existing frame or rough opening, and it must be the same operating style or provide equal or greater opening area than the existing window. This exception does not apply to new sleeping rooms — only to replacements of existing windows in existing bedrooms.
Sprinkler system exception. Homes equipped with an automatic fire sprinkler system installed per NFPA 13D may qualify for a reduced egress requirement in basement sleeping rooms. With a sprinkler system, the basement needs either one compliant egress opening plus one means of egress (stairway), or two means of egress — rather than an egress window in each sleeping room. This exception is uncommon in existing Portland homes but applies to some newer construction.
Egress under decks and porches. Egress windows located under decks, porches, or similar projections are permitted by code — provided the projection allows the window to open fully and provides a path at least 36 inches high from the window to a yard or open area. On Portland homes where a rear deck covers the basement wall, an egress window can still work if the clearance between the deck and the ground meets the 36-inch minimum.
Egress above lower roof surfaces. An egress window that opens onto a lower roof section — common on two-story Portland homes where a bedroom window exits onto a porch roof or first-floor roof — must have an unobstructed path at least 36 inches wide from the window to the nearest roof edge.
Bars, grilles, and covers. Any security bars, grilles, or window well covers placed over an egress opening must be releasable from the inside without a key, tool, or special knowledge. A security grate that requires a key to open doesn't meet code, regardless of the window dimensions behind it.
